Missouri Laws for Dog Attacks
Section 273.036.1 of the Missouri Revised Statutes covers the subject of dog attacks.Per this law, you dog owners can be held liable for injuries when all the following conditions exist:
- Your injury was caused by a dog bite
- You were bitten while on public property or while lawfully on someone else’s private property
- You did not provoke the dog into attacking you
The law further states that dog owners who are found to be in violation of the law are required to pay a fine of $1,000 as well as any damages owed to you, such as medical expenses. This is what is known as a strict liability law, meaning it applies even if the dog owner claims not to have known the dog would bite.
You have five years from the date of the injury to file a claim against the dog owner. In addition to Missouri law, local leash laws and other special law ordinances may apply to your case.
